Please ensure that you read these terms and conditions carefully. These are the legally-binding terms that govern your membership of the Haggle Card service. By becoming a member of the Haggle Card service, you indicate your acceptance of these terms.
Words highlighted in italics are defined at the end of these terms. SUPPLIER OF THE SERVICESWe are DTD Dienstleistungs GmbH (company number HRB 60100 registered in Germany).HOW YOUR MEMBERSHIP WORKSOur agreement with youIn return for our accepting you as a member of the Haggle Card service, you agree to pay us the membership fee. The membership fee is currently £35 per year, including VAT.Payment of the membership feeThe membership fee for the first membership year is payable when you apply for membership.We will deduct the membership fee for the first membership year and each subsequent membership year by direct debit from your bank account, unless you cancel your membership as set out in these terms. We will contact you at least four weeks before the end of each membership year to remind you that the membership year is coming to an end. The reminder will notify you of the membership fee then in force and the final date for cancelling your membership if you do not wish to renew it. Cancellation by you during the first 30 days of your membershipThe minimum membership period is one membership year, unless you cancel as set out in this section.You may cancel your membership during the first 30 days of the first membership year in your membership, before you place an order. We will provide you wish a full refund of your membership fee within 30 days of your cancellation. If you place an order during that period of 30 days, you will lose this right of cancellation. Our provision of the Haggle Card service to you begins immediately upon our accepting your application for membership. Accordingly, you agree that you will lose your right to cancel your membership under the terms of the Consumer Protection (Distance Selling) Regulations 2000 immediately upon our commencement of the Haggle Card service to you. This does not affect any of your other statutory rights, or the cancellation rights you have under these terms. Cancellation by you at the end of each membership yearYou may cancel your membership at the end of each membership year. To do so, you must notify us of your wish to cancel your membership at least 14 days before the end of that membership year. You must notify us using one of the methods set out in the section of these terms headed “Contacting us”, below.Your membership will then continue in force until the end of the membership year, at which point your membership will come to an end. If you do not notify us of your wish to cancel your membership at least 14 days before the end of a membership year, then your membership will automatically renew for a further membership year. Please note that the reason for requiring at least 14 days’ notice of cancellation is to ensure we can arrange the cancellation of your direct debit payment before the start of the next membership year. HOW HAGGLE CARD WORKSThe Haggle Card WebsiteAs a member of the Haggle Card service you can log-on to the website. The website will give links to shopping partners who have agreed to give cash-back to members of the Haggle Card service.Placing ordersIn order to get the cash-back you must place the order by means of the links provided on the website. If you place an order products other than by means of the links on the website, you will not receive any cash-back.How much cash-back will you receive?The amount of cash-back you will receive will vary depending on the product or service that you select and the value of that product.When you identify a product or service that you would like to purchase from one of the shopping partners the website will notify you how much cash-back you will receive for that item. Receiving your cash-backWe will credit the cash-back to your membership account immediately upon receiving the cash-back from the relevant shopping partner. Please note this will typically be between 30 and 60 days after you place the order.Our obligation to make cash-back payments to you is dependent upon our receiving the corresponding cash-back from the shopping partners. If we do not receive cash-back for any reason that does not arise from our negligence or other fault, then we will have no obligation to make any payments to you in connection with that cash-back. If you believe you have not received cash-back to which you were entitled, please contact us and we will use reasonable efforts to obtain the cash-back from the shopping partner. Your membership accountYou may check the balance of your membership account at any time by logging on to the website or by telephoning our customer helpline. Please see the section of these terms headed, “Contacting us”.You may request that we transfer all (or part of) of your balance to your bank account. We will transmit the money within three working days of your request. The minimum transfer is £5, unless you are cancelling your membership. Upon any cancellation of your membership, we will transfer to your bank account an amount equal to the balance on your membership account at the close of the final day of your membership. We will transmit the money within three working days after the final day of your membership. We will transmit to you any cash-back received following cancellation of your membership on a monthly basis, within three working days following the end of the month in which the cash-back is received. Please note in all cases that a further period of up to a week may elapse after we transmit any payment, before the cash-back arrives in your bank account. Repayment of cash-backIf we have to repay any cash-back to a shopping partner, then you must repay the cash-back to us, unless the repayment arises as a result of any negligence or other fault by us or by any person acting on our behalf. Examples of when such a repayment might occur include:
YOUR HAGGLE CARDOnce you have become a member of Haggle Card you will receive your membership card in the post. When you receive your membership card you must sign it immediately.You are not permitted to allow anyone else to use your membership card. It is your responsibility to look after your membership card and to notify us of any changes to your personal details including your address and bank details. If you lose your membership card you must notify us immediately. You will not be able to place an order without your membership card. SHOPPING PARTNERSIf you place an order with a shopping partner for products or services you will be entering into a contract solely with that shopping partner. We have no liability in respect of those products or services, or the provision or non-provision of those products or services.We are not responsible for the availability or content of any of the shopping partners’ websites accessed through this site. If you decide to place an order with any of the shopping partners you do so at your own risk and it is your responsibility to take all protective measures to guard against viruses or other destructive elements. We do not endorse and are not responsible or liable for any content, advertising, products, services or information on or available from shopping partners’ websites. MEMBERSHIP QUALIFICATIONSMembership is open only to UK residents aged 18 or over. If we become aware that you are not a UK resident or are aged under 18 then we reserve the right to cancel your membership immediately. We will refund the membership fee but you will not be entitled to any cash-back in your membership account.OUR LIABILITY TO YOUIf we do not receive cash-back from a shopping partner (and hence we do not make the corresponding payment to you in connection with that cash-back) as a result of any negligence or other fault by us or by any person acting on our behalf, then our maximum liability arising from that non-payment is limited to an amount equal to the unpaid cash-back.If you suffer any other loss or damage because of any other failure by us to comply with these terms or because of any negligence or other fault by us or by any person acting on our behalf then our maximum liability to you for each claim (or series of connected claims) arising as a result is limited to an amount equal to the annual membership fee in force at the time the claim (or first in the series of claims) arises. The above limits do not apply in respect of any liability for death or personal injury arising from our negligence, or for fraud. Our liability for those types of loss is unlimited. It is your responsibility to inform us promptly if any of your contact details change.DEFINITIONSIn these terms, the following words and phrases have the following meanings:cash-back: each payment of cash-back on any order placed by you with a shopping partner, and the corresponding amount received by us from the relevant shopping partner. Haggle Card service: the services we provide to you under these terms. membership account: the account in which we hold your cash-back. membership fee: the annual fee payable by you when you join the Haggle Card service and when you renew your membership. membership year: the period of twelve months beginning on the day we accept your application for membership and on each anniversary of that day (unless you cancel your membership). membership: your membership of the Haggle Card service. order: each order you place for products and/or services from a shopping partner and which is accepted by that shopping partner. shopping partner: any business accessed through our website that offers cash-back incentives for purchasing products or services using the Haggle Card service. website: the Haggle Card website at http://www.haggle-card.co.uk |
